Protocol Steps

TYPICAL PROTOCOL STEPS IN A CATEGORICAL USE OF FORCE

1.  The first responding supervisor will obtain a public safety statement and separate the officers.

2.  The officers will be transported to the station in the company of a supervisor and monitored.

3.  The League attorney will arrive and make contact with the officers.

4.  The officers will be transported out to the scene of the use of force for a walk-through by the monitoring supervisor.

5.  Force Investigation Detectives (FID) will call the officer and his/her attorney to the scene of the use of force.

6.  The officer will be asked by the detectives for a voluntary statement.  The officer declines and the detective orders the officer to cooperate.

7.  The walk-through is conducted for the purpose of establishing positioning, distances, and the extent of the crime scene. The officer’s statements should be short and related to the above.

8.  The officer will be photographed by SID at the Command Post.

9.  The officer’s weapon will be taken by FID and a replacement weapon will be given to the officer.

10.  The officer’s weapon will be subjected to a magazine count in the officer’s presence.

11.  The officer will be transported back to the station by the monitoring supervisor.

12.  There will be a detailed, tape recorded interview of the officer by FID.

13.   The interview will be transcribed and combined with all of the other interviews into the final investigation report and given to the officer’s commanding officer.

14.  The commanding officer will conduct a walk-through of his own with the officer.

15.  A Use of Force Board will be held.

     (a) The Board consists of four staff officers and a peer officer.
     (b) The officer may attend if he wishes.
     (c) The officer will not be asked questions. The officer is an observer.

16.  The commanding officer will make recommendations to the Use of Force Board in three areas.

         (a) The tactics of the officers.
         (b) The drawing and holstering of the officer’s weapon.
         (c) The use of force itself.

17.  The Use of Force Board makes its own recommendations to the Chief of Police.

18.  The Chief of Police makes recommendations to the Police Commission.

19.   The Police Commission is the final adjudicator.
